The Hong Kong Inland Revenue Department (“IRD”) will be releasing the Departmental Interpretation Practice Note (“DIPN”) Advance Pricing Arrangement 48, establishing the procedure for enterprises seeking an Advance Pricing Agreement (“APA”) in Hong Kong. This will enable MNEs for the first time to prospectively lock in their corporate tax position both in Hong Kong and in relevant jurisdictions of the counterparty group entities. This is an important step in terms of managing/improving Hong Kong's international fiscal competitiveness and it signals that the government is ready to back MNEs in their negotiations with overseas jurisdictions.
